1.      Preamble

The following General Terms and Conditions of Sale govern all transactions established on the HAWNA web catalogue. Any order placed on this site assumes the customer’s unconditional and irrevocable acceptance of these conditions.

2.           Subject

This contract is a distance contract which aims to define the rights and obligations of the parties in the context of the sale of the products of the company HAWANA on the Internet, via the platformsecure online payment form of the Interbank Payment Centre.

3.            Definitions


In the remainder of the contract, each of the terms mentioned above shall be understood within the meaning of its definition, namely:

·          «Distance contract» means any contract concerning goods or services between HAWANA Company and a Consumer within the framework of a system of sale or provision of services at a distance organized by HAWANA Company which, for this contract, use exclusively the Internet network until the conclusion of the contract, including the conclusion of the contract itself.

·          “Consumer” means any natural person who, in this contract, acts for purposes that do not fall within the scope of his or her professional activity.

·          «Purchase Order» means a document that indicates the characteristics of the Products ordered by the Consumer and that must be signed by him by «double click» to engage him.

·          «Order» means the act by which the Consumer undertakes to purchase Products and the HAWANA Company to deliver them.

 

4.           Product

 

All products in the catalogue are marketed while stocks last.

HAWANA reserves the right to remove an item from the catalogue without prior notice. Under no circumstances may it be required to compensate or cancel an order as a result of the impossibility to use the purchased product because of incompatibility with the material already owned by the buyer.

 

5.           Place an order


After finding the product(s) you are interested in, click on the “order” button and the product is added to your order form.
You can change your purchase order at any time and you can return to the catalogue by pressing continue shopping.

When you have completed your purchases, validate your order by clicking on the 'pay' button.

In case of error on your part, at the time of your entry on the order form, we advise you to send us within 24 hours a cancellation request by e-mail. After cancellation of the order by HAWANA, you can order again.

 

6.            Price

The prices mentioned in the catalogue are indicated in Moroccan dirham without tax, are valid at the time of their consultation by the customer and are those in force at the time of the order.

VAT is calculated in the purchase order according to the rate applicable on the day of the order. The purchase order and transactions are in Moroccan dirham.

Any change in the rate will be automatically reflected in the price of the products.

 

7.      Execution of the order

The order will be executed at the latest within 7 days from the day following that which the Consumer has placed his order.

In case of unavailability of the Product ordered, the Consumer will be informed as soon as possible and will have the possibility to cancel his order.

He will then have the choice to request either the refund of the sums paid within thirty days at the latest of their payment, or the exchange of the Product.

8.      Delivery

Delivery is not provided by HAWANA. The customer will collect his goods in the delivery address indicated on his Purchase Order.

The Products are delivered to the address indicated by the Consumer on the Order Form. The Consumer is obliged to check the goods upon delivery and to report the damage due to the carrier on the delivery note as well as to the Company HAWANA within one day.

The Consumer may, at his request, obtain the sending of an invoice to the delivery address by validating the option provided for this purpose on the Purchase Order.

How much does the delivery cost?

The costs of transport shall be borne by the buyer,

- Our rates are inclusive of VAT and are calculated on the basis of the weight of the products.
- The cost of transporting your delivery is indicated on your invoice.

- It decreases with the quantity ordered. The best thing is to consolidate your orders.

What are the delivery times?

After receipt of your payment, your order is shipped within 48 hours, subject to stock availability.

In Morocco and abroad, the articles will be sent by registered mail.
Any delays shall not give rise to damages, cancellation of orders or refusal to take delivery.

9.      Method of payment

To pay for your order, you choose the payment method from those offered by HAWANA at the payment page.

In this case, the remittance of the transaction for debit from your account is made within one day following the date of the delivery confirmation.

Your online payments are secured by the Interbank Payment Center (CMI) which offers a fully secure payment service.

The Consumer guarantees the HAWANA Company that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the Purchase Order.

In the case of payment by credit card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the card issuer and between the HAWANA Company and its banking establishment shall apply.

10.  Confidentiality of data

The information requested from you is necessary for the processing
of your order and is treated confidentially.
You have the right to rectification of your personal data.

11.  Right of withdrawal

From the date of delivery of your order, you have a period of 7 days to exercise your right of withdrawal, and be fully refunded. The costs of returning the goods remaining at your expense. However, only goods returned in perfect condition of resale, complete and in their original packaging (unopened) will be refunded.

12.  Guarantee

All products sold in the catalogue are guaranteed against manufacturing defects and material defects. The duration of this guarantee is at least one year (from the date of invoice). In case of return of equipment that is not defective, transportation and handling costs may be charged to the customer. This warranty does not cover damage resulting from accidents, misuse or negligence.

13.  Proof of transactions paid by credit card

The data recorded by the CMI on the online payment platform on behalf of HAWANA constitutes proof of the commercial transactions between you and the company HAWANA.

14.  Force majeure

HAWANA is bound to perform its obligations only to the extent that no force majeure event interferes with them.
